Terms Of Service for users
1. Introduction
These Customer Terms of Service ("Terms") are the rules for shopping on Geek Groovy. They form a binding agreement between you ("you", "customer") and [GEEKGROOVY.COM] ("Geek Groovy", "we", "us", "our"), which operates the website at [geekgroovy.com] and related services (the "Site").
Geek Groovy is a marketplace where independent, up-and-coming artists sell real, human-made artwork and products (such as enamel pins, stickers, keychains, and art prints). When you buy a product, you are supporting the artist who created it.
By browsing the Site, creating an account, or placing an order, you agree to these Terms and to our [Privacy Policy]. If you do not agree, please do not use the Site or buy from us.
Plain-language note: Think of these Terms as the "house rules" for buying things on Geek Groovy. They explain what you're getting, how orders and shipping work, what happens if something goes wrong, and who is responsible for what.
2. Eligibility and Age
2.1 Family-Friendly Store
Geek Groovy is a family-friendly store, and our products are intended for a general audience of all ages.
2.2 Buying as a Minor
If you are under 18 years of age (or under the age of majority where you live), you may only place an order with the involvement and permission of a parent or legal guardian who agrees to these Terms and is responsible for the purchase. By placing an order, you confirm that either (a) you are at least 18 and able to enter into a binding contract, or (b) you have your parent or guardian's permission and they accept responsibility for the order, including payment.
2.3 Accounts for Younger Users
You must be at least [13] years old to create an account. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has given us personal information, please contact us at [support@geekgroovy.com] and we will delete it.
2.4 Accurate Information
You agree that the information you give us — including your name, shipping address, email, and payment details — is true, accurate, and complete, and that you will keep it up to date.
3. Your Account
You may be able to create an account to check out faster, track orders, and save your details. You are responsible for:
a. Keeping your login information (email and password) private and secure. b. All activity that happens under your account. c. Letting us know promptly at [support@geekgroovy.com] if you think someone else has used your account without permission.
We may suspend or close your account if you break these Terms or use the Site in a way that harms Geek Groovy, our artists, or other customers (see Section 13).
4. About Our Products
4.1 Made by Independent Artists
Products on Geek Groovy feature original artwork created by independent artists. Each product is reproduced and printed on physical items (for example, pins, stickers, and prints), sometimes through third-party printing and fulfillment partners.
4.2 Descriptions and Images
We try hard to show our products accurately, but:
a. Colors and finishes may vary slightly from what you see on your screen, because screens display color differently and printing has natural variation. b. Sizes and details are approximate unless stated exactly. c. Small variations between individual items are normal and are not defects, especially for handmade or small-batch products.
4.3 Limited Editions and Availability
Many products are limited editions or are sold in limited quantities (for example, the "X Left!" counters shown during a Battle). Once an item sells out, we may or may not restock it. Listing a product is not a promise that it will always be available, and we may change or discontinue any product at any time.
5. Battles and Limited Drops
The "Battle Mat" is a signature feature of Geek Groovy. Here is how it works and what it means for you as a customer:
a. What a Battle is. From time to time, two products are paired in a head-to-head matchup ("Battle") shown on the live Battle Mat. A Battle runs for a limited time (up to 72 hours) and each product usually has a limited quantity available.
b. How you take part. You take part in a Battle by buying one of the two products before the timer ends or the item sells out. Buying a product is how you support that artist in the Battle.
c. What you receive. When you buy a product in a Battle, you receive that physical product — the same as any other purchase. The outcome of the Battle (which product "wins") does not change what you receive, give you a refund, or entitle you to any prize, unless we clearly say otherwise for a specific Battle.
d. Winners. The winner of a Battle is decided by Geek Groovy at the end of the Battle. Battle results, timers, counters, and animations are for fun and engagement and may not always be perfectly exact.
e. No guarantee of stock. Because quantities and time are limited, we cannot guarantee that an item will still be available when you try to check out. If an item sells out or a Battle ends while it is in your cart, we may not be able to complete that order.
6. Orders
6.1 How an Order Works
When you place an order, you are making an offer to buy the product(s) at the listed price. Your order is accepted, and a contract is formed, only when we send you an order confirmation or ship your item — not when you click "buy" and not when your payment is authorized.
6.2 We May Decline or Cancel Orders
We may refuse, limit, or cancel any order at any time, including if:
a. The product is out of stock or a Battle has ended. b. There was an error in the price or product description (see Section 7.3). c. We suspect fraud, abuse, or a breach of these Terms. d. We are unable to ship to your location.
If we cancel an order you have already paid for, we will refund the amount you paid for the cancelled items.
6.3 Order Limits
We may limit the quantity of any product you can buy, for example to keep limited editions fair for everyone.
7. Pricing, Fees, and Taxes
7.1 Prices
Prices are shown on the product page in [USD] and may change at any time before you place an order. The price that applies to your order is the price shown at the time we accept your order.
7.2 Taxes and Shipping
The price of a product does not include shipping or applicable taxes unless we say so. Any sales tax, VAT, GST, or similar taxes, and any shipping and handling charges, will be shown before you complete checkout and added to your total. Geek Groovy is responsible for collecting and sending applicable sales taxes where we are required to do so.
7.3 Pricing or Description Errors
Sometimes a product may be listed at the wrong price or with the wrong description by mistake. If we discover an error in an item in your order, we may cancel that item (even after you have ordered) and refund you. We will let you know if this happens.
8. Payment
a. Payment is processed through our third-party payment provider, [Stripe / PayPal / payment processor name]. By paying, you also agree to that provider's terms. b. You must use a payment method you are authorized to use. c. Geek Groovy does not store your full card number. Payment information is handled by our payment provider. d. If your payment fails, is reversed, or is charged back, we may cancel your order and/or recover amounts you owe us.
9. Shipping and Delivery
9.1 Where and When We Ship
We ship to the locations listed at checkout. Estimated processing and delivery times are estimates only and are not guaranteed. Because some products are made or printed to order, please allow extra time for production.
9.2 Your Address
You are responsible for giving us a correct and complete shipping address. We are not responsible for orders that are delayed, lost, or returned because of an incorrect address you provided. If a package is returned to us, you may be responsible for re-shipping costs.
9.3 Risk of Loss
Risk of loss passes to you when the carrier (such as the postal service) takes possession of your package, unless the law where you live says otherwise.
9.4 United States Only
At this time, Geek Groovy ships only within the United States (including, where stated at checkout, U.S. addresses such as APO/FPO or U.S. territories). We do not currently accept or ship international orders. If you place an order with a shipping address outside the United States, we may cancel it and refund you.
10. Cancellations, Returns, Refunds, and Damaged Items
Plain-language note: This is one of the most important sections to get right, and it's a real business decision — not just legal wording. Many items here are limited editions or made to order, which is exactly the kind of product that stores often treat as non-returnable. Decide what feels fair and that you can actually honor, and fill in the brackets. Some places have laws giving customers extra cancellation or refund rights (for example, a "cooling-off" period for online orders) — a lawyer or a parent can help you check what applies where you sell.
10.1 Changing or Cancelling an Order
Once you place an order, we begin processing it quickly. You may request a change or cancellation by contacting us at [support@geekgroovy.com], but we can only honor it if we have not yet produced or shipped your item. We cannot guarantee changes after that point.
10.2 Returns
You may return an item within 30 days of delivery for a refund of the product price. To qualify, the item must be unused and in its original condition and packaging, and you must contact us at [support@geekgroovy.com] with your order number to start the return.
Unless the item was damaged, defective, or wrong (see Section 10.3), you are responsible for return shipping costs, and the original shipping charge is not refundable. We recommend using a tracked shipping method, since we cannot refund returns that do not reach us.
10.3 Damaged, Defective, or Wrong Items
If your item arrives damaged, defective, or is not what you ordered, contact us at [support@geekgroovy.com] within [14] days of delivery with your order number and a photo of the problem. If we confirm the issue, we will, at our choice, replace the item or refund you for it. This does not limit any rights you have under the law where you live.
10.4 How Refunds Are Made
Approved refunds are sent back to your original payment method. It may take several business days for the refund to appear, depending on your bank or payment provider.
10.5 Lost or Late Packages
If your package is significantly delayed or appears lost in transit, contact us and we will help track it and work with the carrier. Please understand that once an item is with the carrier, delivery timing is largely out of our control.
11. Intellectual Property
11.1 The Artwork Belongs to the Artists
The artwork and designs featured on our products are owned by the artists who created them. Geek Groovy does not own that artwork — the artists license it to us so that we can produce, display, and sell their products. Other content on the Site (such as page text, graphics, and the Geek Groovy name and logo) is owned by Geek Groovy or its licensors. All of this content is protected by copyright, trademark, and other laws.
11.2 What You Get When You Buy
When you buy a product, you own that physical item. You do not get any right to the artwork or design itself. In particular, you may not:
a. Copy, scan, reproduce, or reprint the artwork or design. b. Make or sell your own products using the artwork or design. c. Use the artwork or design commercially in any way.
You may, of course, personally enjoy, display, gift, or resell the individual physical item you bought (for example, giving a pin to a friend), as long as you do not copy or reproduce the design.
11.3 The Geek Groovy Name and Logo
"Geek Groovy," our logos, and our branding belong to us. You may not use them without our written permission.
12. Reviews and Customer Content
If the Site lets you post reviews, ratings, comments, photos, or other content ("Customer Content"):
a. You keep ownership of your Customer Content, but you give Geek Groovy a non-exclusive, royalty-free, worldwide license to use, display, and share it in connection with the Site and our marketing. b. Your Customer Content must be honest, must be your own, and must not include anything illegal, hateful, harassing, sexual, deceptive, or that violates someone else's rights. c. We may remove any Customer Content at our discretion.
13. Acceptable Use
When using the Site, you agree not to:
a. Break the law or use the Site for fraud. b. Interfere with, hack, overload, or try to gain unauthorized access to the Site or its systems. c. Use bots, scrapers, or automated tools to buy products, scrape data, or unfairly beat limited-edition or Battle limits. d. Resell products in a way that is fraudulent or that violates these Terms. e. Harass, abuse, or harm other users, our artists, or our staff.
We may suspend or ban anyone who breaks these rules, and cancel related orders.
14. Disclaimers
The Site and products are provided "as is" and "as available." To the maximum extent allowed by law, we disclaim all warranties we are legally allowed to disclaim, including implied warranties of merchantability and fitness for a particular purpose, except for any warranties that cannot be excluded under the law where you live (for example, consumer-protection rights that always apply to you). We do not promise that the Site will always be available, error-free, or uninterrupted.
15. Limitation of Liability
To the maximum extent allowed by law:
a. Geek Groovy will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site or any product. b. Geek Groovy's total liability to you for any claim relating to an order will not exceed the amount you actually paid for the product(s) in that order.
Nothing in these Terms limits any liability that cannot legally be limited, including liability for death or personal injury caused by our negligence, or for fraud.
16. Indemnification
You agree to cover and hold harmless Geek Groovy and its artists, partners, and staff from any claims, losses, or costs (including reasonable legal fees) that result from your misuse of the Site, your breach of these Terms, or your violation of someone else's rights.
17. Privacy
We handle your personal information (such as your name, address, and order details) as described in our [Privacy Policy]. Please read it to understand what we collect and how we use it.
18. Governing Law and Disputes
These Terms are governed by the laws of [STATE/COUNTRY], without regard to its conflict-of-laws rules. Any dispute that is not resolved informally will be handled by the [courts located in COUNTY, STATE], and you agree to those courts' jurisdiction — except where the law where you live gives you the right to bring a claim in your local courts.

20. General

No waiver. If we don't enforce a rule right away, that doesn't mean we give up the right to enforce it later.
